Manslaughter is an unintended killing of a human being that is not subject to the specifics of the murder that is set out in the law. These divisions are into two groups - that is, the voluntary ones and the involuntary ones. The court’s definition of criminal law, with some reservations, is considered unsuitable by critics who argue that the discretion in the jury verdict is excessive, while the criteria for determining a criminal act are vague and thus unclear. The report aims to answer this advocacy after starting with the main points. There are mainly two types of Manslaughter: voluntary and involuntary. Voluntary manslaughter refers to the condition where the defendant has mens rea and actus rea in the situation. In simple words, it means that the defendant had the intention of killing a person and had achieved that intention. The law of unintentional manslaughter based on unlawful acts is helpful for the implementation of justice and deterring reckless behaviour that hopefully will prevent further tragedies. However, it brings certain critics of its application against the defendants in such cases. The preponderant dependence on jury discretion, the vagueness in the definition of what is regarded as an unlawful and dangerous deed, and the importance given to the assessment of the defendant’s mental consciousness including his mere rea is always a threatening factor.
