LAWS297: Introduction to Legal Skills

In order to assist your understanding of legal advocacy (and to help you prepare forthe moot court assessments you will complete as part of LAWS297), you are requiredto observe real-life litigation in one of the four main courts.
You are required to complete an Advocacy Report using the template annexed tothese instructions. You must submit your Report by noon on Tuesday 9 July 2024using Nuku. The file name for your Report must include your name and Student ID,and should adopt the following format – ‘LAWS297 – Advocacy Report – Name –30……….’.
The Advocacy Report is not marked and does not contribute to your final grade forLAWS297, but completing it is a mandatory course requirement. Your Report will bereviewed by your tutor to ensure it has been completed to a reasonable standard.
The court you attend will be based on your surname:

4.1 Surnames beginning with A to H – District Court: The District Court inWellington is on Ballance Street. Lists of the cases are normally availablearound the entrance to the Court. You should find a relevant courtroom toobserve.

4.2 Surnames beginning with I to Q – High Court: The High Court inWellington is on Molesworth Street. The daily list showing informationabout what is being heard and when is normally available in the Court’sfoyer, and available online the day before on the Courts of New Zealandwebsite.

4.3 Surnames beginning with R to Z – Court of Appeal or Supreme Court:The Court of Appeal in Wellington is on Molesworth Street, and theSupreme Court is on Lambton Quay. Upcoming cases are available onlineon the Courts of New Zealand website. Note that these Courts sit lessfrequently than the High Court and District Court. If necessary, you mayattend the High Court or District Court instead

5. If you are outside of Wellington for the mid-year break, you may attend a High Courtor District Court in your local area.

6. Courts normally sit from 10am to 1pm, and from 2:15pm to 4:30pm.

7. Note that you will need to observe a hearing of sufficient substance in order to complete the Advocacy Report. Many hearings (particularly in the District Court) canbe very brief and will not be helpful for your purposes. You may need to sit throughseveral such brief hearings, or move from one courtroom to another, in order toobserve a hearing that provides sufficient material.

8. All hearings are open to the public unless the judge(s) make a direction for a ‘closedcourt’.

9. Please behave respectfully when attending court. This means:

9.1 You should take care to enter and leave the courtroom quietly so as not todisturb the proceedings.

9.2 From June 2022, the default position of all courts in New Zealand has beenthat taking notes using a pen and paper is permitted, unless a judge directsotherwise. Note however that you may not take notes using an electronicdevice – only counsel, litigants in person, and the media may do so. If youwish to use an electronic device, you should approach the Registrar (who sitsimmediately in front of the judge(s)) before the hearing begins to ask forpermission.

9.3 You should only take water into the hearing.

10. Some hearings take place remotely (using a Virtual Meeting Room or VMR). If youwish to attend a remote hearing, you should:

10.1 Contact the relevant court some time before the hearing with details of thecase you wish to attend (or the Court may be able to advise which hearingsare available to be attended remotely). The Court will then provide a videolink the afternoon before the hearing; and

10.2 Adhere to the remote viewing protocol, which is available on Nuku.
