Instructions to The Candidate/ Student

• V-class is the ONLY official examination platform.
• Questions must be attempted in the answer booklet/sheet provided on V-class.
• You have SIX HOURS to complete this paper. No exam answer sheet shall be accepted after 6 hours (the system has closed).
• This is an OPEN BOOK (Online) examination.
• Use Font 12, Spacing: 1. Times New Roman & OSCOLA Style of footnoting.
• Answer 4 Questions 2 IN SECTION A AND 2 IN SECTION B
• Questions in Sections A Carry 30 Marks Each, While Section B Carries 20 Marks.
• Each Answer should not be less than 1,000 words (2 Pages).
• Extra credit will be awarded to clearly thought-out, well-structured answers with relevant authorities.
• Number the answers to the questions clearly before answering.
• PLAGIARISM is a grave offence under the University Rules and Regulations and will lead to cancellation of one’s script.
• Review your answers carefully before submitting your exam paper.
• Review the grades assigned to each section of the exam. Allocate your time accordingly.

Question One: (Compulsory)

Ms Namaganda is the Cabinet Minister in charge of Gender, Labour & Social Development, which supervises NSSF and is in charge of appointing the Executive Director of NSSF on the recommendation of the NSSF Board of Directors.

Recently, the NSSF Board sat and considered applications for a new Managing Director of NSSF. During the conduct of the process, Budingo, who was among the Applicants didn’t participate in mandatory interviews for the qualification of the job of Executive Director of NSSF, but was approved by the Board of Directors as a successful candidate, and his name was forwarded to Ms Namaganda for approval.

Instead, Ms Namaganda, on the 11th day of June 2024, in a letter published in the New Vision, 12/06/2024, appointed her tribe mate, Mr Bwino, who participated in the whole process of recruitment of the Managing Director of NSSF, but was not seconded by the NSSF Board of Directors.

Mr Bwino, on the 13th day of September 2023, assumed office and is performing his duties as the new NSSF Managing Director.

Mr Kasenene, who was also a candidate for the job of the NSSF Managing Director but didn’t go through, is aggrieved that Mr Bwino was improperly appointed as the new Managing Director of NSSF and is not certain whether he can sue for judicial review.

QUESTION 2 (COMPULSORY)

Kash is a second-year Law Student at Ghetu University located at Plot 80, Kololo, Prince Charles Drive, Kampala.

Last semester in May 2024, he sat for end of semester exams. The results were released on the 15th day of July 2024, wherein Kash had passed all the course units save for “Law of Equity and Trusts”, where he scored 34%.

He applied for re-mark and was later declared to have passed with 67%.

Last week, Kash was notified by the Dean of the School of Law, Ghetu University, that his results for “Law of Equity and Trusts” had been cancelled for exam malpractice.

The Management scrutinised his paper and realised that there were some inconsistencies to include;

• Some answers marked were written on a booklet not provided by the University.
• his paper had answers written in three different handwritings and using different pens,
• that there was a high likelihood that he hired a mercenary who wrote in his paper during the process of re-marking.

The Dean School of Law also delivered a suspension letter to Kash. The Suspension letter stated that Kash had been involved in exam malpractice and hence he will return to the University after one year.

Kash tried to make an appeal to the University Council but was informed that his act was grievous and could not be entertained at any moment. However, Kash has been informed that his situation can be legally handled under Administrative law.

Concerning administrative law in Uganda, kindly advise Kash on all remedies available to him and the forum where to pursue them. (30 Marks)
