LAW4026 SCENARIO

Hiba Habib has recently graduated from BCU School of Jewellery. Although she has not started a business yet, she has already created a portfolio of jewellery design, and she thinks that selling some of her recent creations can foster her profile as jewellery maker. For this purpose, on 1st March she puts an advert on a local Facebook page: "Five silver rings, exclusive Aesop's 'The Fox and The Grapes' theme, available for £80 each. First come, first served! Call me by phone: 739590001 by 15thMarch". The advert presents a clear picture of the rings, with dimensions.

On 10thMarch, Farid Smith sees Hiba's advertisement and contacts her. He wants all the five rings (for his wife Lavinia, two daughters and two granddaughters), but he asks her to make a slight variation (the dimension of the grapes must be slightly increased); moreover, he requests that Hiba guarantees that "the design is exclusive - I like it a lot, and I want it to be for my family only". Farid wants all the rings ready by 30thMarch, since this is his wife's birthday, and he wishes to make a surprise for her and "the other girls of my family". Since the dimension of the rings will be slightly bigger (due to the change in the grapes) Hiba asks for a total of £450, not £400; she guarantees that 'The Fox and the Grapes' theme is hers, and that she will finish her work by 30th March. Hiba and Farid reach an agreement on these contractual terms.

Two days later, on 12th March, Farid speaks with his son Ahmed, and he discovers that, as a birthday present for his mother, Ahmed booked a holiday for her in Morocco (25thMarch - 5th April). Clearly, this means that Farid needs the rings before the trip, so he immediately calls Hiba to ask for a shorter deadline (24thMarch). Hiba is willing to accept, but with an extra-payment of £100 - so the total price becomes £550. Farid feels that Hiba is just taking advantage of the situation, but reluctantly agrees.
