LAW4008 Assignment Brief 

As part of the formal assessment for the programme, you are required to submit a Public Law assignment. Please refer to your Student Handbook for full details of the programme assessment scheme and general information on preparing and submitting assignments.   

LAW4008 Learning Outcomes:  

After completing the module, you should be able to:  

1.  Demonstrate knowledge and understanding of the principles of public law within a social and political context.

2.  Assess the extent and efficiency of how the courts protect fundamental and administrative rights.    

3.  Explain and apply principles of governmental arrangements in the context of diverse methods and theories of public law.

4.  Construct legal arguments with reference to broad public law principles as well as specific judicial decisions.

Guidance  

Your assignment should include: a title page containing your student number, the module name, the submission deadline and the exact word count of your submitted document; the appendices if relevant; and a reference list (see referencing section for more information). You should address all the elements of the assignment task listed below. Please note that tutors will use the assessment criteria set out below in assessing your work.  

You must not include your name in your submission because Arden University operates anonymous marking, which means that markers should not be aware of the identity of the student. However, please do not forget to include your STU number. Maximum word count: 2,500.

 Please note the following:   

Students are required to indicate the exact word count on the title page of the assessment.    

The word count includes everything in the main body of the assessment (including in-text citations and references). The word count excludes numerical data in tables, figures, diagrams, footnotes, reference list and appendices. ALL other printed words ARE included in the word count.   

Students who exceed the wordcount by up to a 10% margin will not be penalised. Students should note that no marks will be assigned to work exceeding the specified limit once the maximum assessment size limit has been reached.

LAW4008 Assignment Task

Parliament have passed the (fictitious) Mobile Phone Manufacturing Act 2022. The Act allows local authorities to license the production of mobile phones within their area.   

Arden County Council take the following action against mobile phone manufacturers within their local area.   

1.  Bart owns a firm that has been manufacturing mobile phones for 20 years. He has his licence withdrawn, and no reasons are given.   

2.  Lisa applies for a licence to manufacture mobile phones, but it is refused. Arden County Council tell her that they are granting no new licences because there are already seven mobile phone manufacturers in that area, and that is too many. In fact, there are only four mobile phone manufacturers in the area.   

3.  Nelson runs a mobile phone manufacturing factory within the local area and has been constantly reassured by Arden County Council that he will be allowed to continue manufacturing mobile phones in the area. Arden County Council later changed their mind and withdrew its licence.   

Advise Bart, Lisa, and Nelson on whether they can challenge the decisions of Arden County Council through judicial review. Your answer should explain and apply the law on the preliminary issues and grounds. (2,500 words) (100 marks) (LOs: 2,3, and 4)
