LAW1028C Human Rights Law Section 1 Questions

Section 1

Using IRAC method discuss human rights violations in reference to the HRA 1998, ECHR 1950  (limited to the sections and articles we have covered in the module) and cases. Your Section 1 answer  must not exceed 900 words in total (excluding footnotes and bibliography). You are not expected to  add a bibliography. 

Section 1 Question 1:

Marina and Tom were friends. Marina started to act strangely. She was stalking Tom, sending  inappropriate messages. Tom taught Marina was going through a crisis because of what happened to  Jeremy and did not take any of these seriously. The situation escalated. One day Marina drove her car  fast towards Tom, making him fear his life, thinking that Marina would run over him. He did not  report this to the police. A few days later, Tom found a letter threating him of murder. He reported it to  the police however the police said that there is not a signature on the letter and the previous acts of  Marina were unrelated events and Tom should stop being too sensitive. The Police also told him that  the letter must be a prank. The next day, Tom was murdered by Marina. 

Section 1 Question 2:

The government introduced a new policy. The policy is called the matchbox. It allowed prison  managements to host 3 inmates in extra small prison cells of 5.5m2 including a shared open toilet,  with no day light and very little fresh airflow into the cell. The aim is to turn prisons into a hostile  environment where no human rights provisions apply to inmates. A prisoner, called Matthew, wants to  complain about the new conditions of his imprisonment.
