IND2601 Question 1 

Mangangahlaa is a customary practice among certain African communities, particularly in relation to land and community governance. It generally refers to the forced removal or banishment of individuals or families from a community due to various reasons, such as violating customary laws or disrespecting traditional authorities.

According to the Traditional Leadership and Governance Framework Act (2003), traditional leaders must act in accordance with the Bill of Rights. Kabelo's determination is questionable because it appears to be based on personal interest rather than communal welfare. 
  2. Form of the Order The order was delivered through Keletso, the inner council's messenger. In customary law, decisions of traditional leaders should follow community consultations and be endorsed by the inner council. The order appears to lack proper consultation and procedural fairness, making it legally questionable. Additionally, Section 34 of the Constitution guarantees the right to a fair hearing, which Kabelo's actions seem to disregard.
