IND2601 Question 1 

Mangangahlaa is a customary practice among certain African communities, particularly in relation to land and community governance. It generally refers to the forced removal or banishment of individuals or families from a community due to various reasons, such as violating customary laws or disrespecting traditional authorities.

Legal Significance:

Community Governance: Mangangahlaa reinforces social cohesion by ensuring that individuals adhere to the customs and traditions of the community. 

Authority of Traditional Leaders: It reflects the power vested in traditional leaders to regulate community affairs and maintain order. 

Sanction for Non-Compliance: It serves as a punitive measure for individuals who violate community norms, ensuring that others comply. Customary Law vs. 

Constitutional Law: While mangangahlaa is recognized in customary law, it may be challenged under constitutional principles, especially if it violates rights such as dignity, property, and freedom of movement. 

Judicial Scrutiny: South African courts have often ruled that forced removals without due process may be unconstitutional, particularly under Section 9 (equality) and Section 10 (human dignity) of the Constitution.

Validity of Kabelo's Actions

1. Author of the Determination Kabelo, as a traditional leader, has authority over customary matters, including land allocation. However, this power must be exercised within the framework of customary law and national legislation. According to the Traditional Leadership and Governance Framework Act (2003), traditional leaders must act in accordance with the Bill of Rights. Kabelo's determination is questionable because it appears to be based on personal interest rather than communal welfare. 
2. Form of the Order The order was delivered through Keletso, the inner council's messenger. In customary law, decisions of traditional leaders should follow community consultations and be endorsed by the inner council. The order appears to lack proper consultation and procedural fairness, making it legally questionable. Additionally, Section 34 of the Constitution guarantees the right to a fair hearing, which Kabelo's actions seem to disregard.
