Tujuan

Tugasan ini bertujuan mengukur kemampuan pelajar membincangkan sejarah perkembangan mazhab fiqh dalam konteks keilmuan Islam.

Keperluan

Kewujudan mazhab fiqh mencerminkan perkembangan dinamik dalam bidang fiqh Islam, yang berpunca daripada usaha ijtihad terhadap sumber-sumber utama syariah seperti al- Quran, Sunah, ijmak dan qiyas. Perkembangan ini turut dibentuk oleh pelbagai faktor seperti realiti sosial, pengaruh budaya setempat dan latar sejarah umat Islam pasca kewafatan Nabi Muhammad SAW.

Berdasarkan pernyataan di atas, jawab soalan-soalan berikut:

• Huraikan perkembangan politik, sosial dan intelektual dalam pemerintahan awal Islam yang telah menyumbang kepada lahirnya mazhab-mazhab fiqh.
• Bincangkan perbezaan mazhab fiqh yang mempengaruhi pelaksanaan hukum Islam dalam konteks pelbagai struktur pemerintahan Islam sepanjang sejarah.
• Adakah kewujudan pelbagai mazhab fiqh merupakan kelemahan atau kekuatan dalam sistem perundangan Islam? Beri pendapat anda dengan merujuk kepada prinsip-prinsip fiqh dan realiti pemerintahan.

Purpose

This assignment aims to measure students' ability to discuss the history of the development of Islamic jurisprudence schools in the context of Islamic scholarship.

Requirments

The existence of the schools of Islamic jurisprudence reflects the dynamic development within the field of Islamic jurisprudence, stemming from the efforts of ijtihad based on the primary sources of shariah such as the Qur'an, Sunnah, ijma', and qiyas. This development was also shaped by various factors, including social realities, local cultural influences and the historical background of the Muslim ummah following the passing of Prophet Muhammad (SAW).

Based on the statement above, answer the following questions:

• Describe the political, social, and intellectual developments during the early Islamic governance that contributed to the emergence of the various schools of Islamic jurisprudence.
• Discuss the differences among the schools of Islamic jurisprudence and how these differences have influenced the implementation of Islamic law within the context of various Islamic governance structures throughout history.
• Is the existence of various schools of Islamic jurisprudence a weakness or a strength in the Islamic legal system? Provide your opinion by referring to the principles of Islamic jurisprudence and the realities of governance.
